Since the landmark 2015 ruling in favour of Mrs Tove Grimsbo against Anfi SL, thousands of timeshare owners have successfully pursued compensation and contract-nullity claims in the Spanish courts. Over the past decade, these judgments have created powerful legal precedents, particularly for contracts signed after 5 January 1999 that breached Spain’s strict consumer-protection rules on timeshare sales.
But in 2025, an important question has begun to surface across the legal and consumer-protection community: are Spanish timeshare claims approaching a “sunset date”? And if so, what does this mean for past and present members of schemes such as Anfi, Club La Costa, Diamond Resorts, Silverpoint, Seasons and others?
A Changing Legal Landscape… and a Ticking Clock
Recent legislative changes in Spain, including Ley Orgánica 1/2025, have introduced a new five-year limitation period for certain types of claims. While there is still legal debate about how, and to whom, this limitation applies, some experts believe this could be interpreted as a countdown that eventually restricts the ability of present/past timeshare owners to pursue mis-selling or contract-nullity cases.
Although no universal “cut-off date” has been formally confirmed, many industry commentators point to January 2030 as a potential end-point for some types of claims.
What is absolutely clear, however, is this:
> Timeshare owners who delay may find themselves unable to take action later - not because their case isn’t valid, but because time has simply run out.

> Adding further urgency is the fact that many of the major timeshare developers are already in insolvency proceedings:
Club La Costa (CLC) – liquidation
Anfi – liquidation of key entities + criminal investigation
Silverpoint – liquidation
Diamond / Apollo – restructuring and entity changes
When companies collapse, the legal process becomes slower, more complex, and in some cases, recovery of funds becomes harder. Acting sooner maximises the chance of a successful outcome.
Don’t Forget the Partner-Lender Claims
Some of the most substantial refunds come not from the timeshare companies themselves, but from the finance providers who partnered with them. Two of the biggest names are:
Barclays Partner Finance (Clydesdale Financial Services Ltd)
Shawbrook Bank
Both lenders have set aside significant compensation provisions after regulatory scrutiny over how loans were arranged during high-pressure sales presentations. Many customers were sold long-term finance agreements without proper affordability checks, statutory cooling-off information, or fair explanations of what they were buying.
These claims remain very much alive — but again, delays only increase the risk of missing out.

“In 2016 I was on a holiday with my parents and my sister. We were staying at Anfi Tauro Golf resort and had no knowledge of Timeshare. We were presented with an opportunity to upgrade our rooms and have a look at some sort of apartment, which is how we got dragged into a combined ANFI/RCI system. Since paying for this we have never been able to use it. TIMESHARE EXIT
